Welcome to HORECA WAY. This electronic platform is entirely owned and operated by "Business Way Establishment" (hereinafter referred to as the "Platform" or the "Establishment"). These Terms and Conditions constitute a legally binding agreement between the Establishment and the user (whether an individual, a company, or an advertiser). By using or registering on the Platform, you expressly agree to be bound by these terms in full.

2. Modification of Terms

  • HORECA WAY reserves the absolute right to amend, update, or change these Terms and Conditions at any time without prior notice.
  • It is the user's responsibility to review this page periodically. Continued use of the Platform following any modifications constitutes an implicit acceptance of the updated terms.

3. Services and Free Registration for Companies

  • The Platform allows companies and establishments to add their information, photos, and commercial data free of charge for the purpose of introducing their activities and facilitating accessibility within the hospitality and food sector.
  • All data and images uploaded by companies must be accurate, continuously updated, and reflective of the actual reality of the commercial activity.

4. Financial Disclaimer and Interactions Between Members

  • The HORECA WAY platform is a business directory, communication platform, data publishing tool, and expertise-sharing space only. It does not intervene, in any way or form, in deals, commercial transactions, or financial relations between members or companies.
  • Absolute Disclaimer: Any financial or commercial relationship arising between members or companies is entirely their personal responsibility. Neither the Platform nor "Business Way Establishment" bears any legal or financial liability resulting from fraud, late payments, or failure to fulfill mutual agreements and contracts.
  • Alert: Every user must thoroughly verify and validate the identity, seriousness, and creditworthiness of the other party before conducting any financial or commercial transaction.

5. Advertisements and External Links

  • The Platform contains advertising spaces and links leading to external websites operated by third parties.
  • Neither the Platform nor its owning Establishment assumes any responsibility for the content of these advertisements, the quality of the advertised products or services, or the privacy policies of those external websites.

6. Intellectual Property

  • All logos, designs, texts, software, interfaces, and trademarks associated with HORECA WAY are the exclusive intellectual property of "Business Way Establishment" and may not be copied, modified, or used without prior written permission.
  • The user grants the Platform a non-exclusive, royalty-free license to host and display the content and images they upload solely for the purpose of operating the Platform and promoting the added activities.

7. Governing Law and Dispute Resolution

  • These Terms and Conditions shall be governed by and construed in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia.
  • In the event of any dispute or disagreement arising from the use of the Platform or the interpretation of these terms, the parties shall seek an amicable resolution. If a resolution cannot be reached, the dispute shall be referred exclusively to the competent judicial authorities and committees in the Kingdom of Saudi Arabia.

II. Acceptable Use Policy

This policy defines the ideal code of conduct and strict rules to be followed in the community, blog, and company pages within HORECA WAY:

1. Content and Publishing Guidelines

Members and companies are strictly prohibited from publishing or sharing any content that falls under the following categories:

  • Political and Religious Content: It is strictly forbidden to publish any offense against the State, its regulations, laws, political symbols, or any disrespect toward religions, celestial laws, and sacred beliefs.
  • Personal and Commercial Abuse: Publishing content that involves defamation, slander, insults, bullying of individuals, or attempting to tarnish the reputation of competing companies and establishments is strictly prohibited.
  • Misleading and False Content: It is strictly prohibited to publish fake news, rumors, misleading information, or fraudulent reviews intended to harm others or deceptively promote a specific entity.
  • Out-of-Scope Content: The Platform specializes exclusively in the Hospitality, Restaurants, Hotels, Food, and Beverage sector (HORECA). Publishing any content, questions, discussions, or images that deviate from the Platform’s core specialization and professional scope is strictly prohibited.

2. Prevention of Exploitation by Competitors

  • Any entity, website, or platform competing with HORECA WAY is strictly prohibited from exploiting the Platform’s community, blog, or company pages for direct or indirect marketing of their own sites or services, or attempting to poach the Platform's users.
  • Using private messages, replies, or comments to send unsolicited promotional spam promoting competing services is strictly banned.

3. Optimal Use of the Community and Blog

  • The Platform's community and blog were created to raise questions, share expertise, exchange professional knowledge, and develop the HORECA sector. Therefore, all replies and participations must remain professional, respectful, and objective.
  • The Platform management reserves the full right to delete any violating content or ban and delete the account of any member who violates this Acceptable Use Policy instantly and without prior notice, without assuming any liability toward the violating member.

4. Indemnification

  • The user agrees to indemnify, defend, and hold harmless HORECA WAY and Business Way Establishment against any legal claims, losses, liabilities, or expenses (including attorneys' fees) arising out of their violation of this Acceptable Use Policy or the overall Terms and Conditions.

III. Personal Data Protection and Privacy Policy

The HORECA WAY platform, owned by Business Way Establishment, is fully committed to absolute clarity, transparency, and security regarding data handling. Data collected on the Platform is categorized into two distinct types under this policy:

1. Data Classification and Nature of Use

  • Type One: Commercial and Activity Data (Publishable and Commercially Usable Data)
    • Includes: Commercial company/establishment name, business activities, products, branch addresses, public contact channels (public phone numbers, official business emails), and uploaded profile images.
    • Nature of Use: By registering, the user (company/establishment) provides an explicit, final, and unconditional consent that this data is available for public viewing on the Platform for all visitors and members. Furthermore, the company acknowledges and agrees that the Platform and "Business Way Establishment" hold the full right to use this data commercially, sell it, or share it with third parties as part of data directories, reports, and studies provided by the Establishment to serve and develop the HORECA sector.
  • Type Two: Personal Data and Information (Fully Protected Confidential Data)
    • Includes: Personal names of company owners or managers, their personal phone numbers, and their private emails.
    • Nature of Use: This data is collected solely for the purpose of enabling your use of the Platform, verifying identities, authenticating company profiles and data, and ensuring their overall security. In the event of data changes or a turnover of the individuals managing the company’s account on HORECA WAY, the Platform will utilize this primary data to communicate with the main authorized entity to verify, update records, and protect the account from unauthorized access or tampering.
    • Confidentiality Commitment: The Platform and the owning Establishment strictly and absolutely pledge that this personal information is completely confidential and shall never be published, sold, rented, or disclosed to any external entity for commercial or marketing purposes. It is securely maintained in a highly protected technical environment.

2. Data Security and Confidentiality

  • We implement strict technical, administrative, and physical security measures to protect all data from unauthorized access, alteration, disclosure, or destruction. However, since no data transmission over the internet can be guaranteed 100% secure, the Platform cannot guarantee absolute security and disclaims responsibility for any breach resulting from force majeure circumstances outside its control. Members are strongly advised to keep their account passwords strictly confidential.

3. Mandatory Legal Disclosure

  • The Platform and its owning Establishment reserve the right to disclose any data (whether commercial or personal) only if such disclosure is required by the applicable laws and regulations in the Kingdom of Saudi Arabia, or in compliance with a judicial order or an official request issued by competent governmental and security authorities.
